This is a claim for an alleged appropriation of land in connection with a grade crossing elimination and for consequential damages allegedly resulting from the grade crossing elimination. The case was previously tried in this court and claimant was awarded the sum of $14,000 (8 Misc 2d 286). On appeal to the Appellate Division of the Supreme Court, Fourth Department, the judgment of the Court of Claims was reversed on the law and facts and a new trial granted. (6 A D 2d 993.)
