This is an application by James E. Healy for an order to quash and set aside a certain presentment made by the grand jury of the county of Queens at the April, 1936, term of the County Court of Queens county.

The presentment reads: “ We, the members of the April, 1936, Grand Jury, have made a thorough and exhaustive investigation of the complaint of Fred A. Staab, an Assistant Deputy Sheriff of Queens County, concerning an undated resignation signed prior to his appointment.
