This case presents error from the’ district court of McIntosh county, and involves the determination of the heirs of Sam Butler, a deceased Creek Indian, who died intestate, prior to the selection of his allotment. There is no controversy between the parties as to the time of the descent cast, or as to the law governing the same. To correctly decide who are the heirs of Sam Butler, deceased, it is necessary to determine whether Sam Butler was ever married to Jennie King, nee Tiger, according to the laws, customs, and usages of the Creek Tribe or Nation of Indians.
