Defendant was indicted on a charge of having caused the death of Sarah Feinberg by performing a criminal operation upon her.
1. The first assignment is to the refusal of the court to direct a verdict for defendant. We think there was sufficient evidence to support the verdict. We have the testimony of the doctor who examined the body of Mrs. Feinberg after her death and found that she had been pregnant and had progressed to the fourth or fifth month, that there had been an abortion, followed by blood poisoning causing death.
