Appeal by the defendant, Henry O. Fischér, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on the 9th day of November, 1896, upon-the verdict of'a jury, and also from an order entered in said clerk’s office on the 20th day of November, 1896, denying the defendant’s motion for a new tidal made upon the minutes.

Action to recover damages for personal injuries alleged to have been occasioned by the fault of the defendant. The defendant owned and occupied iron foundry premises situated on the south side of Green street in the city of Brooklyn. Along those premises on both sides of the sidewalk, on that side of the street, were castings of the defendant, leaving a space in the center of the walk for footmen to pass along upon it.
