MORTON, District Judge.
This is an appeal by a Chinese from an order of United States Commissioner Fiske directing his deportation on the ground that he was found in the United States in violation of the Chinese Exclusion Act. The order was entered on November 16, 1904, and the appeal was allowed and was entered in this court on November 16, 1904. On April 15, 1909, this court entered the following order: “The above-entitled case is hereby dismissed from the docket for want of prosecution.” On May 4, 1911, United States Commissioner Fiske having died since the entry of his order of…
