This case is in this court on appeal from the court of common pleas, and it involves the right of the county commissioners to build the new county jail on what is known as the “ court house grounds ” in the city of Akron, Ohio.

It is claimed by the plaintiffs that the commissioners of the county hold the property upon which the jail is being built in trust for the use of the public at large, and they aver that the dedication of the property was such by Simon Perkins that they have such an interest in it, both on account of their being members of the public and citizens of the county, and by…
