FUNDERBURK, Justice.
The appeal is from a judgment in favor of A. J. Shirley against Gulf Refining Company for $1,500. The award was for damages for personal injuries received by plaintiff in an automobile wreck, the result of a collision between plaintiff’s car and one owned and driven by J. W. Phillips. It was alleged that said J. W. Phillips was an agent and employee of the defendant and that “at the time was acting within the scope of his employment and on a mission for the company.” The defendant, in addition to defensive pleas, asserted a cross-action against M.
