GALLAGHER, Chief Justice.
This suit was instituted by appellant, L. P. Price, against appellee, White Line Cab & Baggage Company., to recover damages for personal injuries alleged to have been sustained by him as the result of being struck by one of appellee’s cabs operated by its employee. Appellee, among other defenses, alleged that appellant had, for a valuable consideration, released it from any and all liability of every kind and character growing out of his having been struck by said cab.
