MEEK, District Judge.

The facts, so far as necessary to be stated, are given in the opinion. Claimant, R. H. McNatt, contends the bankrupt company became a joint contractor with one Brown for the construction and erection of claimant’s house. The eighteenth paragraph of the contract, which is the basis of the contention as well as for the claim presented against the estate of the bankrupt, provides in terms that the- S. P.
