On August 14, 1923, the appellant, a mutual fire insurance association, issued a policy of fire insurance to the respondent, James H. Albro, insuring a bam and its contents, with certain other property, against loss by fire. The barn and its contents were destroyed by fire on the day preceding the date of the issuance of the policy'; the association nevertheless adjusted the loss and paid to Albro in settlement thereof the sum of $970.
