The original bill was filed by complainant against the defendants for the purpose of enjoining the defendants from rebuilding and1 repairing an old levee or dike, by which it is alleged in the bill would result in holding back and overflowing complainant’s lands by diverting the water from the natural flow and backing it up and causing it. to run over the land of complainant, resulting in irreparable damage and injury to the land of complainant.
