MEMORANDUM
TAURO, District Judge.
I. Introduction
Plaintiff Evans Cabinet Corporation contends that Defendant Kitchen Interna tional, Inc. has failed to pay Plaintiff pursuant to a contract to manufacture and supply cabinetry. Plaintiff brings common law claims for: (1) breach of contract; and (2) unjust enrichment. Presently at issue is Defendant’s Renewed Motion to Dismiss, which this court converts into a Motion for Summary Judgment For the following reasons, Defendant’s Motion is ALLOWED.
