Hutcheson, Justice.

Julian, alias Pat, Patterson was convicted of the murder of Virginia Walden. He filed a motion for new trial, which contained the general grounds and forty-four special grounds. This motion was overruled, and he excepted. The indictment was divided into five counts. Code of 1933, § 37-701. Each count charged the defendant with the murder of the same person upon the same date, and differed only as to the manner of its commission.
