ORDER AND OPINION
MORGAN, District Judge.
On March 27, 1995, the appellant filed a Notice of Appeal. The appeal contests the decision of the bankruptcy court granting the appellee’s Motion for Summary Judgment and denying the appellant’s Motion to Dismiss. On May 15, 1995, the appellant submitted his brief in support of his appeal. The appellee responded on May 26, 1995. On June 5, 1995, the appellant filed his reply brief.
