There is no dispute regarding the basic facts underlying the conviction of Charles M. Henault (the defendant) for violation of G. L. c. 90, § 24(2)(a1/2)(2).1 Sometime before *99 p.m. on Saturday, October 17, 1998, the defendant, a life-long resident of Pittsfield, had left a friend’s home and was driving westbound on Crane Avenue. During the three hours prior to his departure, he had been drinking beer with his friend.
