This was an action for damages by plaintiffs in error against the defendant in error, based upon a failure of the defendant in error to perform its contract and agree*397ment to deliver to the plaintiffs in error two telegraphic messages, sent to them from Galveston by one Watson, who was connected with the hardware and iron house of J. S. Brown & Co.
