This was an action brought before a justice of the peace of Pratt county, by J. H. V. Brown, against the Chicago, Kansas & Nebraska Railway Company, for injuries alleged to have been received by the plaintiff through the negligence of one of the employés of the railway company. At the time when the alleged injuries occurred the plaintiff was employed as a section-man under Daniel Shanahan, the *386section foreman, and the duties of both were upon what was known as the Chicago, Kansas & Nebraska Railway; but who their employer was, whether…
