MEMORANDUM AND ORDER

LISI, District Judge.

This is an action by Foxon Packaging Corporation (“Foxon”) against Aetna Casualty and Surety Company (“Aetna”) for (1) breach of contract, (2) “breach of covenant of good faith and fair dealing in violation” of certain fiduciary duties, and, (3) a violation of R.I.G.L.1956 (1985 Reenactment) § 9-1-33. 1 This court has diversity jurisdiction pursuant to 28 U.S.C. § 1332.
