—This was a suit at law to recover from E. L. Parker, defendant in error, upon tbe common counts for moneys paid, moneys received and accounts stated, the sum of $5,000.00 alleged to have been paid by the Lake Dorr Land Company, plaintiff in error, on account of the purchase price of certain property contracted to be sold under written agreement providing for the payment of installments and the giving of a purchase money mortgage prior to the execution of a conveyance.
