*315It appears from the record before us on this appeal that one John W. Grayson died in 1909, intestate, the owner and in possession of a fifty acre tract of land lying in Johnson county just without the corporate limits of Van Lear, a mining town owned by the appellant, Consolidation Coal Company, a corporation engaged in the mining and marketing of coal and other minerals.
