Patrick O’Connor sued William Dils, before a justice of the county of Kanawha, fora certain sum of money lost at gambling. He moved to quash summons, because it summons him to answer an action “for damages for a wrong” instead of “money due on contract.” The justice overruled the motion, but rendered final judgment in favor of *55defendant. Plaintiff appealed, and the circuit court rendered judgment in his favor for the sum of one hundred and nine dollars.
