This is an appeal from a judgment of the lower court dismissing plaintiff's suit for its failure to comply with an order of court entered on October 7, 1940, sustaining a motion for a bill of particulars and prayer for oyer with leave to plaintiff to amend.

The suit is by the American Employers' Insurance Company to recover from D.O. Furr premiums earned by policies of workmen's compensation and public liability insurance issued by plaintiff to Furr covering his operations as a general contractor during the period from June 25, 1938, to December 17, 1939.
