QUINN, Chief Justice.
In this appeal the People challenge the legality of several sentences imposed on the defendant, Ronald Steven Montgomery, in a resentencing proceeding. 1 The defendant had originally been charged with and convicted of three substantive felonies, and was sentenced to life imprisonment as a habitual criminal with three prior felony convictions. However, one of the prior felony convictions used as a predicate for the habitual criminal sentence was later determined to be constitutionally infirm.
