This complaint was filed on April 28,1972, by the plaintiff, Lutz Engineering Co., Inc. (Lutz), seeking an order for discovery in aid of an arbitration proceeding involving a dispute with the instant defendant, Sterling Engineering & Construction Company, Inc. (Sterling).
The record discloses that on July 17, 1970, Sterling entered into a subcontract with Lutz for the performance of •certain work in the construction of the John H.
