GRIMES, Judge.

This appeal considers the proper disposition of a case on remand after the reversal of a judgment entered in favor of a defendant upon the defendant’s motion for a directed verdict made at the close of the plaintiff’s case.

The case began when Raymond Hodges, as personal representative of the estate of Charles A. Giramaire, filed a complaint against Mr. and Mrs. Surratt alleging fraud, undue influence, and conversion and seeking damages and the return of both real and personal property.
