This action, commenced in the Court of Common Pleas for Greenville County, August, 1930, by E. M. Anderson, as plaintiff, against C. P. .Ballenger, doing business as Ballenger Paving Company, was instituted for the recovery of damages for personal injuries alleged to have been sustained by the said E. M.
