In dissenting from tlie opinion of the majority of the court, I deem it necessary to set forth the main allegations of the petition.

Petitioner alleges that he was convicted in the district court of Ottawa county, Okla., on two charges, and on the 21st day of May, 1923, was sentenced on the first conviction to five years at hard labor in the state penitentiary at McAlester, and to pay a fine of $5,000 and costs; that on the said 21st day of May, 1923, on the second conviction was sentenced by the court to imprisonment in the penitentiary for a term of four years, at hard labor and a fine of…
