Appeal from an order of the Supreme Court at Special Term, entered June 16, 1976, which granted leave to the claimant to file a late notice of claim. Decedent died on March 27, 1975, allegedly as a result of bullet wounds he sustained the previous day through the negligence and *643assault of defendant police officers who were in the employ of the defendant village.
