1. The exceptions present questions of some difficulty and of great importance, namely: (1) In respect to the validity and effect of sec. 2355, R. S., which provides that “ when either, party shall be sentenced to imprisonment for fife, the marriage shall be thereby absolutely dissolved,, without any judgment of divorce or other legal process, and’ no pardon granted to the party so sentenced shall restore ¡ *275such party to Ms or her conjugal rights.” (2) Whether the marriage of the defendant with the former wife of French, which took place after his conviction and sentence to imprisonment for…
