The defendant, appellant herein, Edward Simmans, hereinafter referred to as defendant, was indicted and convicted for a violation of Section 2911.01, Revised Code. Defendant was, at the time charged in the indictment, the Safety Service Director of Port Clinton. The first count of the indictment reads as follows:

“The jurors of the grand jury of said county, on their oaths, in the name and by the authority of the State of Ohio, do find and present that Edward N. Simmans late of said County, on or about the 14th day of November in the year of our Lord one thousand nine hundred and sixty-four at…
