Proceeding pursuant to CPLR article 78 (transferred to this *708Court by order of the Supreme Court, entered in Albany County) to review a determination of the Commissioner of Correctional Services which found petitioner guilty of violating certain prison disciplinary rules.

While under escort, petitioner became disruptive and made verbal and physical threats. As a result, he was served with a misbehavior report which charged the violation of several prison disciplinary rules.
