Dear Representative Lynn:

This opinion is in response to your questions asking:

Do the preemption provisions of Section 573.080 RSMo. prohibit a municipality from enacting ordinances which would regulate:(a) Location of adult-oriented book stores, movie houses, and other businesses that deal in explicit sexual material, by means of zoning regulations? . . .(b) Display of explicit sexual material and material depicting nudity, including bare female breasts, when such material is displayed within the premises of a business establishment in such fashion as to be visible to minors who enter into…
