Daniel Solovy brought an action pursuant to 42 U.S.C. § 1983 alleging that two members of the Utica police department, Sergeant Jerome Carroll and Officer Gregory Morabito, violated his Fourth Amendment right to be free from excessive force. Solovy claimed that Sergeant Carroll and Officer Morabito applied excessive force when they used handcuffs to pull him from his vehicle and force him to the ground, ignored his complaints that his handcuffs were too tight, and picked him up by the handcuffs.
