This is an application under the habeas corpus act. The petitioner, Emily James, alleges that Laura Doyle, a child of eight years, is unlawfully restrained of her liberty by one William Conn. The name of the respondent is, however, George Conn. He brought the child into court in obedience to the writ. The testimony of witnesses for *160petitioner and respondent was heard at great length. The facts appear to be substantially as follows : —
