SIMPSON, Justice.

This is an action in the nature of ejectment to recover possession óf a part of Lot 11, Block 25 in the town of Whistler, Alabama. From a verdict and judgment for the plaintiff, the defendant has appealed.

The plaintiff rested his right of recovery on prior possession and having a deed from the State Land Commissioner. It appears from said deed that the lot — No. 11 — was regularly offered for sale by the Tax Collector of Mobile County for the 1938 delinquent ad valorem taxes due by Exchange Land Company, the owner of said lands, after a decree duly entered by the probate…
