The offense charged is murder, and the punishment affixed is confinement in the penitentiary for fifteen years.

Appellant was charged with killing Martha Durham by beating her with his hands and stomping her with his feet. The testimony shows that Gene Hill, a married man with a wife and child, was riding in a Model T Ford coupe on Sunday afternoon in August, 1936, on a general drinking party — sometimes with young girls and boys — and that he had drunk so much whisky that he grew sick therefrom, but continued to drive and drink.
