MEMORANDUM OPINION AND ORDER

JUSTICE, District Judge.

This civil action arises out of plaintiff’s frustrated attempt to open a retail store for the sale of alcoholic beverages in Coffee City, Texas.

Coffee City is a municipality with less than 250 inhabitants, located on State Highway No. 155 between Tyler and Frankston, Texas. Under the state local option laws, the inhabitants of Coffee City have legalized the sale of alcoholic beverages within the municipal boundaries.
