Many errors are assigned by appellant and argued by its. counsel, but as we view the case it is unnecessary for a proper disposition of it to consider but two matters urged by the'appellant. The controlling and important questions, as we think, arise from the refusal of the court to give the peremptory instruction directing a verdict for appellant-, and the giving by the court of instruction No. 2 given at the request of appellee.
