The plaintiff moves for permission to serve an amended complaint. It is a corporation organized under and pursuant to the provisions of the Transportation Corporations Law of the State of New York, and is engaged in the business of carrying *893passengers for hire in its motor coaches or vehicles. The defendant operates the railroad line which runs from the city of Watertown to the village of Carthage, which line passes through the village of Felts Mills, in the county of Jefferson, N. Y.
