The Reporter's statement of the case: The claim in the above-entitled case was transmitted to the court by the Committee on Claims of the House of Representatives on the 17 th day of February, 1905, in pursuance of the act of March 3, 1883, commonly called the Bowman Act. This case is one of a class originally referred to this court to find the facts and make report thereof to Congress under the provisions of the act of March 3, 1883, commonly known ■ as the Bowman Act, 22 Stat., 485. The jurisdiction of the court is invoked for judgment to be entered against the Government (for the sum of $15,000 in this particular case) under and by virtue of an amendment to the Bowman Act providing for judgment in certain cases, which amendment is set forth in the act of March 3, 1887, commonly known as the Tucker Act, 24 Stat., 505. Section 13 of the Tucker Act provides:
