MORTON, District Judge.

The plaintiff is an importer and manufacturer of sugar and its products, and brings this action to recover certain sums of money alleged to have been received by the defendant from the United States as drawback duties on three lots of syrup manufactured by the plaintiff, which were sold by it to the E. H. Sherburne Company for export, and were subsequently exported. The case was heard jury-waived.
