Defendant David Earl Ewing, Jr., and three others were involved in a “drug-rip” — where the seller takes the buyer’s money without ever handing over the drugs — gone bad. The victim was shot but survived, and defendant and his cohorts were caught trying to escape.
Defendant was convicted of multiple offenses and various enhancements, including — as alleged in count four of the information — that he shot at an occupied vehicle for the benefit of, at the direction of, or in association with a criminal street gang under Penal Code section 186.22, subdivision (b)(4).
