Statement of the case by G-keen, Judge: This was a chancery suit brought September 12, 1887, in the Circuit Court of Braxton county. The bill was filed at October rules, 1887, and it alleged, that the plaintiff, L. M. Frame, was the son of William B. The first question presented by this record is: Will a court of equity specifically enforce in any case or against any one a verbal gift of land from a father to a child, as in some cases it is difficult, if not impossible, in principle to distinguish gifts and sales ? I will before considering directly this question state briefly the law in reference to the specific enforcement of verbal sales of land and the principles, on which it is based.
