On May 12, 1913, Hubert B. Tanner executed and delivered to tbe Union Central Life Insurance Company, hereinafter called tbe insurance company, a mortgage on a tract of about 53 acres of land in Ballard county to secure tbe payment of an indebtedness evidenced by notes in tbe sum of $1600. On May 14, 1913, Hubert B. Tanner sold tbe property to James F. Dale and tbe latter, as part of tbe consideration assumed tbe payment of tbe $1600 mortgage indebtedness to tbe insurance company.
