This suit was commenced in the Circuit Court for the County of Nassau, by the issuing of summons and filing a complaint under the provisions of the “ Act concerning Forcible Entry and Detainer,” approved August 11-,1868.
The parties appeared and proceeded to trial and a verdict was rendered in favor of the complainant, whereupon the counsel for defendant moved to set aside the verdict upoe the ground (among others) that the proceedings should have been had in pursuance of the Code of Procedure, and that the act of 1868 was repealed by the substitution of the Coda The court set aside the…
