This was a trover suit by the Consolidated Warehouse Company'against J. R. Smith for the recovery of a certain platform scale. The defendant answered, denying the material allegations of the petition, and alleged that the title to the scale was in him and H. J. Durdle, a non-resident, and that the right to the use, possession, and enjoyment of it was in them.
