Appeal by the defendant, Beed Manufacturing Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Erie on the 11th day of August, 1913, upon the verdict of a jury rendered by direction of the court.

Merrell, J.:

On October 3, 1906, the defendant, a manufacturing corporation organized under the laws of New York, having its factory and principal office at Newark, Wayne county, N. Y., entered into a contract in writing with the plaintiff, also a New York corporation, located and having its principal office at the city of Buffalo, whereby the defendant agreed to manufacture for and sell to the plaintiff 25,000 Yacuo Sanitary Carpet Cleaners of a style and in accordance with a sample furnished by plaintiff.
