M. C. Stoner was indicted in the superior court' of Gordon county for a violation of the prohibition statute of 1907 (Acts 1907, p. 81), in that he did “unlawfully . . sell and barter, for a valuable consideration, Cook’s Malt Ale, Bud near beer, the same being malt liquors.” A demurrer was interposed to the indictment, and the writ of error is for the purpose of testing’ the validity of the judgment overruling the demurrer.
