The plaintiff claimed title to the demanded premises, as tenant in common with the other heirs of Elea-zer Bowen, the father of both the parties. The defendant’s title was by deed from his father to him and his brother Anthony, and a subsequent deed from Anthony, of his share or interest in said lands to the defendant.
